These terms of use (the "Terms") are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of the Jiggyconnect website at www.Jiggyconnect.com (the "Site") and any related mobile or software applications ("Jiggy") including but not limited to delivery of information via the website whether existing now or in the future that link to the terms (collectively, the "Jiggy platform or Services").

Please read these terms and conditions carefully before ordering any products/services from our site. By accessing or using Jiggy platform and placing an order, you agreed to be bound by these terms and conditions and concluding a legally binding contract with ENSOURCE DIGITAL WORLD FZ LLC/LLE and/or its affiliates. If you do not accept these terms and conditions in full, please do not use our services or if you have any questions relating to these terms and conditions, please contact us on info@ensourcedigital.com before you place an order. Your use of the Jiggy platform is at your own risk, including the risk that you might be exposed to content that is objectionable, or otherwise inappropriate.

In order to use the services, you must first agree to the terms. You can accept the terms by:

• Clicking to accept or agree to the terms & conditions available on the registration page, or in the user interface for any service; or
• Actually, using the services. In this case, you understand and agree that Jiggy will treat your use of the services as acceptance of the terms from that point onwards.

You should also read our privacy policy, which also governs your use of our platform and sets out the terms on which we may process any personal information that we collect about you, or that you provide to us, and is incorporated by reference into these terms. The privacy policy can be found here.

If you are a merchant, your use of Jiggy will be governed by the terms of the merchant agreement between you and Jiggy platform.

ABOUT JIGGY

Jiggyconnect.com or Jiggy platform is a online marketplace service jointly operated by ENSOURCE DIGITAL WORLD FZ LLC and its affiliates ("We" or "Us" or "Jiggy"), incorporated and registered with Media Zone Authority, Abu Dhabi as Limited Liability Company (LLC), whose registered office is at TwoFour54 Building No.6, Hotel Park Rotana Complex, Khalifa Park, Abu Dhabi, UAE with Business License No. B.L.816/19 and ENSOURCE DIGITAL WORLD FZ LLE incorporated and registered with Fujairah Media FRee Zone, Creative City as Limited Liability Establishment (LLE) whose registered office is at Creative Tower, Fujairah Media Free Zone, Fujairah, UAE with Business License No. 15768/2020.

Jiggy is a platform which act as service provider where products or services are offered by a variety of independent businesses (our "Partners") and are promoted, presented & fulfilled by us on behalf of our partners, or in some cases, by our partners themselves.

RELATIONSHIP

• Jiggy acts as an aggregator of services and the provider of the transaction platform for the processing of services by customers. Jiggy enters into this sub-merchant agreement with the users or visitors (“you”) of this site (“Jiggy platform) through this document on behalf of and as an agent of the partners. The user (“you”) agrees to use the services and in exchange pay to Jiggy the fees specified in fees section below.
• the client ("you") acknowledges that:
  • Jiggy is not a bank and the service is an authorization and processing service rather than a banking service; and
  • Jiggy is not acting as a trustee, fiduciary or escrow with respect to the funds which are processed by each transaction but is acting only as an aggregator and temporary custodian of the funds in exchange for the fees which will be transferred to partners in line with merchant agreement signed between Jiggy & Partners.

USE OF SERVICES AND ACCESSING JIGGY PLATFORM

• Access to our site and to our services is permitted on a temporary basis, and we reserve the right to withdraw or amend access to our site or our services without notice.
• We will not be liable if, for any reason, our site or our services is unavailable at any time or for any period.
• From time to time, we may restrict access to some parts of our site or our services, or our entire site or services to users who have registered with us.
• You are responsible for maintaining the confidentiality of your login details and any activities that occur under your account. If you have any concerns about your login details or think they have been misused, you should contact us on info@ensourcedigital.com straight away to let us know.
• You may use our services only for lawful purposes. The platform is currently made available to you for your personal, non-commercial use, free of charge.
• You may not use our site or our services in any way that breaches any applicable local, national or international law or regulation or to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards.
• You also agree not to access without authority, interfere with, damage or disrupt any part of our site or our services or any network or equipment used in the provision of our services. We will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the platform will cease immediately.

CHANGES TO TERMS AND SERVICES

We may vary or amend or change or update these terms, from time to time entirely at our own discretion to comply with any regulatory requirements or if there are changes to our business practices. You shall be responsible for checking these terms from time to time and ensure continued compliance with these terms. Your use of our platform will be subject to the most recent version of the terms available on the platform.

We aim to update our site and our services regularly and may change the content at any time. If the need arises, we may suspend access to our site and our services or close them indefinitely. Any of the material on our site or our services may be out of date at any given time, and we are under no obligation to update such material.

CONTENT GUIDELINES

These content standards apply to any and all material which you contribute to our services (the "Contributions"), and to any interactive services associated with it. By submitting your content, you hereby irrevocably grant Jiggy a perpetual, irrevocable, world-wide, non-exclusive, fully paid and royalty-free, assignable, sub-licensable and transferable license and right to use your content and all IP rights therein for any purpose including API partnerships with third parties and in any media existing now or in future. By "Use" we mean use, copy, display, distribute, modify, translate, reformat, incorporate into advertisements and other works, analyze, promote, commercialize, create derivative works, and in the case of third-party services, allow their users and others to do the same. You grant us the right to use the name or username that you submit in connection with your content. You irrevocably waive, and cause to be waived, any claims and assertions of moral rights or attribution with respect to your content brought against Jiggy or its users, any third-party services and their users.

You must comply with the spirit of the following standards as well as the letter. The standards apply to each part of any contributions as well as to its whole. Contributions must be accurate (where they state facts), be genuinely held (where they state opinions) and comply with the applicable local law. Please refer to the governing law and dispute resolution clause (below) for more details. Contributions must not:

• Contain any material which is defamatory of any person, obscene, offensive, hateful or inflammatory, promote sexually explicit material or promote violence or promote discrimination based on race, sex, religion, nationality, disability or age;
• Infringe any copyright, database right or trademark of any other person;
• Be likely to deceive any person or be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidentiality or promote any illegal activity;
• Be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety or be likely to harass, upset, embarrass, alarm or annoy any other person;
• Be used to impersonate any person, or to misrepresent your identity or affiliation with any person or give the impression that they emanate from us, if this is not the case; or
• Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
• You are responsible for your content. You represent and warrant that you are the sole author of, own, or otherwise control all of the rights of your content or have been granted explicit permission from the rights holder to submit your content.
• If your content is a review, you represent and warrant that you are the sole author of that review; the review reflects an actual service experience that you had; you were not paid or otherwise remunerated in connection with your authoring or posting of the review; and you had no financial, competitive, or other personal incentive to author or post a review that was not a fair expression of your honest opinion.
• You assume all risks associated with your content, including anyone's reliance on its quality, accuracy, or reliability, or any disclosure by you of information in your content that makes you personally identifiable. While we reserve the right to remove content, we do not control actions or content posted by our users and do not guarantee the accuracy, integrity or quality of any content. You acknowledge and agree that content posted by users and any and all liability arising from such content is the sole responsibility of the user who posted the content, and not Jiggy.

We reserve the right, at any time and without prior notice, to remove, block, or disable access to any content that we, for any reason or no reason, consider to be objectionable, in violation of the terms or otherwise harmful to the services or our users in our sole discretion. Subject to the requirements of applicable law, we are not obligated to return any of your content to you under any circumstances.

We may, without prior notice, change the services; add or remove functionalities or features; stop providing the services or features of the services, to you or to users generally; or create usage limits for the services.

TRANSLATION OF CONTENT

Jiggy may provide a translation of the English version of the terms & content on Jiggy platform into other languages. You understand and agree that any translation of the terms or content of platform into other languages is only for your convenience and that the English version shall govern the terms of your relationship with Jiggy. Furthermore, if there are any inconsistencies between the English version of the terms or content on the platform and its translated version, the English version of the terms or content shall prevail over others.

You understand and agree that Jiggy:

• shall use all reasonable service to provide the translation services on the platform in accordance with this agreement for information purpose only and should not be relied upon as accurate, and
• shall not be liable to the client or any person claiming through or under the client for any loss or damage arising out of any failure to provide the translation services or any translated content on the platform.

SUSPENSION AND TERMINATION

Failure to comply with content guidelines in these terms constitutes a material breach of the terms, and you agree that any termination of your access to the services may be affected without prior notice, and acknowledge and agree that we may immediately take following actions:

• Immediate, temporary or permanent withdrawal of your right to use our services;
• Immediate, temporary or permanent removal of any posting or material uploaded by you to our services;
• Issuing of a warning to you;
• Legal action against you including proceedings for reimbursement of all costs on an (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
• Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

The responses described in this clause are not limited, and we may take any other action we reasonably deem appropriate.

You can delete your account at any time by contacting us via the "contact us" link at the bottom of every page and ceasing further use of the services. We may terminate your use of the services and deny you access to the services in our sole discretion for any reason or no reason, further, you agree that we shall not be liable to you or any third party for the discontinuation or termination of your access to the services.

SERVICES AVAILABILITY

We do not guarantee that our platform will always be available, be uninterrupted, secure or free from bugs or viruses, nor that the platform will be free from errors or omissions.

We shall not be liable for any delay or failure to perform resulting from causes outside of our reasonable control, including, without limitation, any failure to perform due to unforeseen circumstances or cause beyond our control such as acts of god, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, epidemic or other natural disaster, shortages of transportation facilities, fuel, energy, labour or materials or a failure of public or private telecommunications networks.

ORDERS

When you place an order through our platform, an email thanking you for your order and confirming your order has been received and accepted by the partner (the "Confirmation Email") will be sent to you by us on behalf of the partner where we are directly providing the services. The contract for the supply of any product/service you order through us will be between you and the partner and will only be formed when you have been sent a confirmation email by us. Please ensure that you have given us a correct email address as this is how we will communicate with you about your order. Jiggy seeks to provide a quality services and will be the first contact in the event there is a problem with your order. We do monitor our partners very closely and it is of utmost importance to us that they comply with our standards and help us maintain our reputation. Please let us know if you have any comments relating to our partner or in respect of the orders by emailing or calling our customer services in your respective country through our contact us page.

• Jiggy is not a manufacturer, seller or distributor of product/service and merely places an order against the partners on behalf of the users pursuant to the unconditional and irrevocable authority granted by the users to Jiggy, and facilitates the processing of orders only between users and partners, under the contract for services between the users and partners which might be different from these terms.
• Jiggy shall not be liable for any acts or omissions on part of the partner including deficiency in service, wrong delivery, quality of service, time taken etc.
• While placing an order you shall be required to provide certain details, including without limitation, contact number and delivery address. You agree to take particular care when providing these details and warrant that these details are accurate and complete at the time of placing an order. By providing these details, you express your acceptance to Jiggy’s terms and privacy policies.
• Delivery of an order placed by you through the Jiggy platform may either be undertaken directly by the partner against who you have placed an order or facilitated by Jiggy through third-party ("partners") who may be available to provide services to you (“delivery partners”). In both these cases, Jiggy is merely acting as an intermediary between you and the partners, or you and the delivery partners, as the case may be.
• You may be charged a delivery fee for delivery of your order by the delivery partner or the partner, as the delivery partner or the partner may determine ("delivery charges"). You agree that Jiggy is authorized to collect, on behalf of the partner or the delivery partner, the delivery charges for the delivery service provided by the partner or the delivery partner, as the case may be. The delivery charges may vary from order to order, which may be determined on multiple factors which shall include but not be limited to order value, distance, demand during peak hours. Jiggy will use reasonable efforts to inform you of the delivery charges that may apply to you, provided you will be responsible for delivery charges incurred for your order regardless of your awareness of such delivery charges.
• All prices listed on the Jiggy platform are correct at the time of publication and have been placed as received from the partners. While we take great care to keep them up to date, the final price charged to you by the partner may change at the time of delivery. In the event of a conflict between price on the Jiggy platform and price charged by the partner, the price charged by the partner shall be deemed to be the correct price.
• Any amount that may be charged to you by Jiggy over and above the order value, shall be inclusive of applicable taxes.
• Delivery periods/pickup time quoted at the time of ordering are approximate only and may vary. When you opt for pickup, you shall be solely liable to ensure compliance with the conditions governing the pickup at the time of placing the order, and Jiggy shall not be liable in any manner in this regard.

CANCELLATION & REFUNDS

Jiggy provides a platform that allows you to initiate transactions with partners and pay or receive payment for products or services. You acknowledge that the Jiggy is not party to any transaction you enter into with any person using Jiggy platform.

• You acknowledge that Jiggy does not enable the return of funds to your account once you have authorized a transaction (known as a “approved order”). Your entitlement to cancel an order you place with a partner or to claim a full or partial refund of any payment you make to a partner will be subject to the terms and conditions of the relevant recipient of your order or payment.
• A partner may agree to refund an amount to your account:
  • By notifying Jiggy and processing the refund using functionality provided by Jiggy; or
  • Using the merchant’s own refund procedure. You acknowledge that the Jiggy has no obligation to provide any refund functionality or to honor any refund request it receives from a partner. You further acknowledge that the Jiggy is not responsible or liable for any refund processed using any partner’s refund procedure.
• You acknowledge that your cancellation, or attempted or purported cancellation of an order shall amount to breach of your unconditional and irrevocable authorization in favour of Jiggy to place that order against the partners on your behalf ("authorization breach"). In the event you commit an authorization breach, you shall be liable to pay the liquidated damages of an amount equivalent to the order value. You hereby authorize Jiggy to deduct or collect the amount payable as liquidated damages through such means as Jiggy may determine in its discretion, including without limitation, by deducting such amount from any payment made towards your next order.
• In the event you have provided incorrect particulars, e.g., contact number, delivery address etc., or that you were unresponsive, not reachable or unavailable for fulfillment of the services offered to you, you will not be eligible for any refunds.
• No replacement / refund / or any other resolution will be provided without partner’s permission.
• All refunds shall be processed in the same manner as they are received, unless refunds have been provided to you in the form of credits, refund amount will reflect in your account based on respective banks policies.
• You will be automatically eligible for refund and will be processed immediately by Jiggy as per process if money has been deducted from your account or card but order couldn’t be processed due to some unforeseen reasons or technical issues. The money will be credited to your account/credit card as per bank’s policies.
• All refunds will be subject to a bank charge of 5% which will be deducted from the amount agreed by the partner for refund to you.
• In the event, YOU erroneously send a payment to a wrong party or have entered wrong account details or have sent a payment for a wrong amount, Jiggy shall have no liability in this regard and your only recourse will be to contact such third party to whom such payment was sent and seek a refund (if any). Jiggy will not refund or reverse a payment erroneously made by YOU.
• Sale of services that includes recharge or top-up or vouchers are final with no exchange or refund permitted.

PAYMENTS

We are authorized by our partner to accept payment on their behalf and payment of the price of any product/services to us will discharge your obligations to pay such price to the partner store. We accept VISA and MASTER CARD as modes of payments which are processed through our payment gateway partners (“payment gateways”). When you make a payment for products and services on our platform, the details you are asked to submit will be provided directly to our payment gateway via a secured connection. The company has chosen to work with established and certified payment gateways and is as such not liable for any potential lapse or breach at the payment gateway.All payments done on our platform will be processed in Emirati Dirham (AED) as default currency for all services while you might pay in different currency if payment is processed by our partners directly on thier platform.You, as the cardholder must retain a copy of transaction records and Merchant policies and rules.

SERVICE FEE

Jiggy is an intermediary between the customer and the partner, not a service provider to under the regulations of the ministry of commerce. We are charging customers for providing a service, please be aware that the fee may be increased or decreased at any time. A nominal fee is applicable per transaction as convenience fees & taxes. The company reserves the right to add or amend fees at its discretion. For overseas transactions, where an exchange rate has been applied, the actual amount that you are charged may vary as our payment processors FX rate may be slightly different at the time of settlement. The total amount (inclusive of all applicable taxes and charges) that you will be required to pay will be displayed clearly before you are asked to confirm your transaction.

PROMOTIONS

Jiggy may from time to time introduce promo coupons, referral, cashback schemes, rewards programs and/or incentive-based programs for its users (program). These program(s) maybe governed by their respective terms and conditions. By participating in the program, users are bound by the program terms and conditions as well as the Jiggy platform terms. Further, Jiggy reserves the right to terminate / suspend the user's account and/or credits / points earned and/or participation of the user in the program if Jiggy determines in its sole discretion that the user has violated the rules of the program and/or has been involved in activities that are in contravention of the program terms and/or Jiggy platform terms or has engaged in activities which are fraudulent / unlawful in nature. Furthermore, Jiggy reserves the right to modify, cancel and discontinue its program without notice to the user.

PROMO CODES TERMS:

• Jiggy promo codes are only valid on the Jiggy platform.
• All promo codes must be entered before confirming a partner transaction
• Only 1 promo code can be applied to 1 transaction at a time.
• An expired promo code is no longer valid to use.
• All promo codes validity is limited to date, usage and limit
• Promo codes used for the purpose of reselling
• Unless otherwise stated, promo codes are not valid in conjunction with other promotions or discounts
• Promo codes are not exchangeable for cash
• Jiggy will not be liable and/or be required to offer replacement promo codes, discounts, credits, cash or otherwise compensated customers for:
  • Discontinued or cancelled promo codes
  • Improper use of, or inability to redeem a promo code
• Jiggy is liable to refunding or extending the acceptance of a promo code in case of any technical issues.
• Jiggy reserves all the rights to change these terms and conditions or cancel any promotions at any time and without any prior notice.

JIGGY REWARDS PROGRAM

Jiggy Rewards is operated by Ensource Digital World FZ LLC/LLE and is the loyalty program offered to all the registered users of My Jiggy Mobile Application or Jiggy Website (www.jiggconnect.com). All users are automatically enrolled in this program after successful verification of their account. These program(s) maybe governed by their respective terms and conditions. By participating in the program, users are bound by the program terms and conditions as well as the Jiggy platform terms. Further, Jiggy reserves the right to terminate / suspend the user's account and/or credits / points earned and/or participation of the user in the program if Jiggy determines in its sole discretion that the user has violated the rules of the program and/or has been involved in activities that are in contravention of the program terms and/or Jiggy platform terms or has engaged in activities which are fraudulent / unlawful in nature. Furthermore, Jiggy reserves the right to modify, cancel and discontinue its program without notice to the user.

JIGGY REWARDS TERMS:

• Jiggy Rewards are earned through promotions published from time to time in the form of cash back, use of promo codes or any other form.
• Jiggy Rewards can only be redeemed on Jiggy Pay service related to Bill Payments & Online Recharge ONLY & is not valid on any other services on Jiggy Platform.
• Rewards shall mean the grant of credit in the form of Jiggy Rewards Points, shall be added to the users 'Rewards' section of his/her 'Jiggy Wallet’, and shall in no event imply that the cashback shall be credited to a user’s bank account or card account or refunded in cash at any time.
• Rewards Points cannot be assigned/ transferred to any other person.
• Rewards can be redeemed at the time of payment by selecting 'Use Jiggy Rewards' as full or partial amount for Jiggy Pay Service ONLY on Jiggy Website or Mobile Applications and no other platform, website, store or otherwise.
• Jiggy Rewards are valid for lifetime and has no expiry.
• Jiggy Rewards Points has no monetary value & are not exchangeable for cash, promo codes or any other form.
• Jiggy Rewards points value is based on the service selected by the user and the value of each point is determined at the time of payment only which may be different for different service.
• Jiggy will not be liable and/or be required to offer replacement promo codes, discounts, credits, cash or otherwise compensated customers for:
  • Banned User accounts or inaccessible accounts.
  • Improper use of, or inability to redeem points.
• Jiggy reserves all the rights to change these terms and conditions or cancel any promotions at any time and without any prior notice.

INTELLECTUAL PROPERTY RIGHTS

We are the owners of or the licensee of all intellectual property rights in our platform and services, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use any content on our site in any way except for your own personal, non-commercial use. Any violation by you of the license provisions contained in this section may result in the immediate termination of your right to use the services, as well as potential liability for copyright and other IP rights infringement depending on the circumstances.

LIMITED LIABILITY

To the extent permitted by law, Jiggy provides services and content on an "as-is" and "as available" basis and we make no representation or warranty of any kind, express or implied, regarding the content or availability of our services, or that it will be timely or error-free or that defects will be corrected. Subject as provided below, neither Jiggy nor any partner shall have any liability to you for any direct, indirect, special or consequential losses or damages arising in contract, tort (including negligence) or otherwise arising from your use of or your inability to use our services. In the event, that Jiggy or the partner is found to be liable to you our total aggregate liability is limited to the purchase price of the product you have paid for in your order. This does not include or limit in any way Jiggy’s or any partner’s liability for any matter for which it would be illegal for us or it to exclude, or attempt to exclude, our or its liability, including liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation. There are some partners where Jiggy’s role and responsibility is solely acting as an intermediary between the customer and the products in exchange only for the fees, without any liability to the entity of origin as it relates to service fees or delivery fees. Jiggy is only an intermediary and it’s not responsible for the preparation of the items. The partner may offer an alternative for any product they cannot provide you with.

PERSONAL INFORMATION

We collect certain data about you as a result of you using our services. This is described in more detail in our privacy policy.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Jiggy parties from and against any third party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs and expenses (including reasonable legal fees) suffered or reasonably incurred by us arising as a result of, or in connection with: (i) your content, (ii) your unauthorized use of the services, or products or services included or advertised in the services; (iii) your access to and use of the services; (iv) your violation of any rights of another party; or (v) your breach of these terms, including, but not limited to, any infringement by you of the copyright or intellectual property rights of any third party. We retain the exclusive right to settle, compromise and pay, without your prior consent, any and all claims or causes of action which are brought against us. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us and you agree to cooperate with our defense of these claims. You agree not to settle any matter in which we are named as a defendant and/or for which you have indemnity obligations without our prior written consent. We will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

DISCLAIMER OF WARRANTIES

You acknowledge and agree that the services are provided "as is" and "as available" and that your use of the services shall be at your sole risk. To the fullest extent permitted by applicable law, Jiggy, its affiliates and their respective officers, directors, employees, agents, affiliates, branches, subsidiaries, and licensors ("Jiggy parties") disclaim all warranties, express or implied, in connection with the services including mobile apps and your use of them. To the fullest extent permitted by applicable law, the Jiggy parties make no warranties or representations that the services have been and will be provided with due skill, care and diligence or about the accuracy or completeness of the services' content and assume no responsibility for any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the services, (iii) any unauthorized access to or use of our servers and/or any and all personal information stored therein, (iv) any interruption or cessation of transmission to or from the services, (v) any bugs, viruses, trojan horses, or the like which may be transmitted to or through the services through the actions of any third party, (vi) any loss of your data or content from the services and/or (vii) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the services. Any material downloaded or otherwise obtained through the use of the services is done at your own discretion and risk and you will be solely responsible for any damage to your computer system or other device or loss of data that results from the download of any such material. The Jiggy parties will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services. You are solely responsible for all of your communications and interactions with other users of the services and with other persons with whom you communicate or interact as a result of your use of the services. No advice or information, whether oral or written, obtained by you from Jiggy or through or from the services shall create any warranty not expressly stated in the terms. Where our platform contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them. Please note that your use of such third party services will be governed by the terms of service and privacy policy applicable to the corresponding third party. Further, it is up to you to take precautions to ensure that whatever links you select or software you download (whether from our platform or other websites) is free of such items as viruses, worms, trojan horses, defects and other items of a destructive nature. Our inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites or any association with their operators.

USER RESPONSIBILITIES

As a user of the platform you are responsible for any user content (text, photos, reviews, links, etc.) that you upload to Jiggy. You must ensure that you have all the rights in respect of any content which you publish on the Jiggy platform and that any user content does not violate the rights of third parties.User who are using the website & are Minor /under the age of 18 shall not register as a User of the website and shall not transact on or use the website.

In particular, you must not create and upload any user content that:

• Is advertising disguised as a review;
• Does not have specific content for a reviewed item;
• Is not objective or intentionally untrue;
• Is immoral, pornographic or in any other way offensive;
• Infringes upon the rights of third parties, in particular copyright;
• Violates applicable laws in any way or constitutes a criminal offence;
• Contains viruses or other computer programmes that may damage software or hardware or that may affect the use of computers;
• Is a survey or chain letter; or
• Is aimed at collecting or using personal data from other users, especially for commercial purposes.
Additionally, you agree not to:
• Use our platform or its contents for any commercial purpose;
• Make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand;
• Access, monitor or copy any content or information of our platform using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;
• Violate the restrictions in any robot exclusion headers on our platform or bypass or circumvent other measures employed to prevent or limit access to our platform;
• Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;
• Deep-link to any portion of our platform (including, without limitation, the purchase path for any hotel services) for any purpose without our express written permission which we may withdraw at any time in our discretion; or
• "frame", "mirror" or otherwise incorporate any part of our platform into any other website without our prior written permission which we may withdraw at any time in our discretion.

If your activity on our platform shows signs of fraud, abuse or suspicious activity, Jiggy may deny its services to you, and close any associated Jiggy accounts. If you have conducted any fraudulent activity, Jiggy reserves the right to take any necessary legal action and you may be liable for monetary losses to Jiggy, including litigation costs and damages. To contest the cancellation of a booking or freezing or closure of an account, please contact Jiggy customer service.

ADVERTISING

Some of the services are supported by advertising revenue and may display advertisements and promotions. These advertisements may be targeted to the content of information stored on the services, queries made through the services or other information. The manner, mode and extent of advertising by Jiggy on the services are subject to change without specific notice to you. In consideration for Jiggy granting you access to and use of the services, you agree that Jiggy may place such advertising on the services.

Part of the site may contain advertising information or promotional material or other material submitted to Jiggy by third parties or users. Responsibility for ensuring that material submitted for inclusion on the Jiggy platform or mobile apps complies with applicable international and national law is exclusively on the party providing the information/material. Your correspondence or business dealings with, or participation in promotions of, advertisers other than Jiggy found on or through the Jiggy platform and or mobile apps, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, shall be solely between you and such advertiser. Jiggy will not be responsible or liable for any error or omission, inaccuracy in advertising material or any loss or damage of any sort incurred as a result of any such dealings or as a result of the presence of such other advertiser(s) on the Jiggy platform and mobile application.

Any personal information that we collect about you as you browse and use our platform will be used in accordance with our privacy policy. ELECTRONIC COMMUNICATIONS

You agree to receive communications from us electronically, including but not limited to email, sms, mms, and telephonic calls. You also agree to receive communication from us based on usage history via sms, email & phone call. This includes offers, discounts and general information. You can choose to optout as per modes advised in the communication.

You acknowledge that any communication by us may be susceptible to error, omission and/ or inaccuracy. You agree that you will not hold us liable for any loss, damages, claim, expense including legal cost that may be incurred/ suffered by you on account of our communication.

GOVERNING LAW AND DISPUTE RESOLUTION

Any claims (including non-contractual dispute or claims) arising from, or relating to, the use of this platform or our services shall be governed by the laws of Media Free Zone, Abu Dhabi, UAE and shall be subject to the exclusive jurisdiction of the Courts of the Abu Dhabi, although we retain the right to bring any suit, action or proceeding against you for breach of these terms in your jurisdiction of residence or any other relevant jurisdiction. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such court.

You must commence any legal action against us within one (1) year after the alleged harm initially occurs. Failure to commence the action within that period shall forever bar any claims or causes of action regarding the same facts or occurrence, notwithstanding any statute of limitations or other law to the contrary. Within this period, any failure by us to enforce or exercise any provision of these terms or any related right shall not constitute a waiver of that right or provision.

Jiggy is committed to customer satisfaction, so if you have a problem or dispute, we will try to resolve your concerns. But if we are unsuccessful, you may pursue claims as explained in this section.

You agree to give us an opportunity to resolve any disputes or claims relating in any way to the platform, any dealings with our customer service agents, any services or products provided, any representations made by us, or our privacy policy by contacting Jiggy’s customer support here. If we are not able to resolve your claims within 60 days, you may seek relief in court.

Any and all proceedings to resolve claims will be conducted only on an individual basis and not in a class, consolidated or representative action.

FORCE MAJEURE

No party shall be liable to the other for any delay or non-performance of its obligations under this agreement arising from any cause beyond its control including, without limitation, any of the following: act of god, governmental act, war, fire, flood, explosion or civil commotion.

SEVERABILITY

If any provision of this agreement is judged to be illegal or unenforceable, the continuation in full force and effect of the remainder of the provisions shall not be prejudiced.

GENERAL TERMS

These terms contain the whole agreement between the parties relating to its subject matter and supersedes all prior agreements, arrangements and understandings between the parties relating to that subject matter. None of the provisions of these terms shall be deemed to constitute a partnership or agency between you and Jiggy and you shall have no authority to bind Jiggy in any form or manner, whatsoever.We will not trade with or provide any services to OFAC and sanctioned countries.
